Employment Law

The 2010 constitution heralded a fundamental shift in the Employer-employee power relations from a contractual one to a rights based relationship. The rights and responsibilities of each counterparty to an employment relationship is now fairly well set out in law and have been fairly well clarified by a litany of case law in disputes litigated before a specialist Employment and Labour Relations Court.

The dispute resolution team has considerable experience advising public and private entities including employers, employees and trade unions on a broad spectrum of labour issues in Kenya and have ben instrumental in precedent setting employment disputes before the Employment courts and along the appellate chain of courts all including the Supreme Court of Kenya.

Our expertise in this area include:

  • Disciplinary processes
  • Unfair dismissals
  • Planned restructuring, redundancies and retrenchments.
  • Collective bargaining
  • Employment contracts for local and foreign contracts of service and services
  • Occupational health and safety and workmen’s compensation
  • Advising on immigration law compliance for expatriates.
  • Transfer of Undertakings
